First and foremost- Washington state residents voted on I-1639 mandating (among other things) the transfer of ownership for firearm sales. DO NOT post firearms on this site eluding to the sale, or transfer of firearms without an FFL background check. This activity gets sites shut down. You will be removed for this.
These Terms may be updated by FR occasionally. You acknowledge and understand that it is your sole responsibility to check for updates and changes to this agreement from time to time. An up to date version of these terms will always be available here in the “Terms of Use” section of FR. Any use by you of BPS after an amendment is made to “Terms of Use” constitutes consent to the agreement.
Registration
Registration may or may not be required to use any, all or parts of the Site. If you decide to register, you must complete the FR registration process. The registration process involves either a social media login or the submission of a valid e-mail address with a password as well as (you) selecting a username and password during the registration process, and be at least 18 years of age. If you are between the ages of 16 and 18, you may use FR only under the supervision of a parent or legal guardian who has read and agrees to these Terms governing FR. You are responsible for maintaining the confidentiality of your username and password, and all uses of your account, whether or not you have authorized such use. You agree to notify FR of any unauthorized use of your account.
FR reserves the right to refuse Service (access to the Site) to any user for any reason without liability to you. This right extends to accounts created by users who impersonate another user, by either name, email address or other personally identifiable information (including pictures or verbiage).
USE
You agree not to use, distribute, provide or sell software (except for software exclusively licensed to or by us) or services that interact or operate with FR, (for example, Spiders, Scripts, Scrapers, and/or Crawlers). Intentionally misleading, unsolicited, unlawful, or predatory postings (spam) are also prohibited. You agree not to collect any users' personally identifiable information ("PII") and/or contact information.
Nothing in this section shall waive rights that are not waivable with respect to consumer protection laws in various jurisdictions throughout the USA.
FR may from time to time, without liability to you, modify, discontinue, terminate, suspend or shut-down (for any amount of time) all or a portion of FR without prior notice.
FR cannot guarantee that this site will be uninterrupted, timely, secure, or error free. You may also cancel your Account at any time.
Payments
Buyers regularly enter into a verbal (or other) agreement with a seller at which time both parties may elect to make payment by cash, check or other means accepted by both parties. Above stated payments are made directly between the buyer and the seller to complete these transactions, using terms mutually agreed upon. FR is not involved in third party transactions and/or exchanges of money that take place between its users.
Content
You understand and agree that unless expressly stated, FR in no way governs (controls), verifies or endorses information posted by other users on its servers and databases to include listings, links, messages, emails, user ratings, private messages or advertisements.
FR does not provide any warranty as to your use of third-party content or software that you obtain from the Site (software sale, purchase, distribution and use are prohibited at FR.) You are also fully responsible for any Content you post on the Site and for the consequences of any such Content. Although FR does not claim ownership of Content that its users post, by posting Content to the Service, you automatically grant, and you represent and/or warrant that you have the right to grant, to FR an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute any such Content and to prepare derivative works of, or make other works of, such Content, and to grant and authorize sublicenses to third parties.
User Conduct
You agree to act responsibly and to treat all other users with respect.
Harassment towards other users will not be tolerated. FR recognizes
intellectual property rights of its users. You may not post, distribute, or
reproduce in any manner any copyrighted material, trademarks, or other
proprietary information that you do not have legal authority to use. If you
believe that your work has been infringed upon in any way that constitutes
copyright infringement, or that your intellectual property rights have been

You agree not to post, email, or in any way make available the following content:
• Ad's or "Posts" alluding to the sale of a Firearm without a background check and transfer as required by Washington state law.
• NFA items or any Machine guns
• Software
• Harassing, stalking, or excessively bothersome content
• Copyrighted material or intellectual property that is not yours
Ownership
All rights, title, interest in and/or Fire Reload; Fire, Reload; Fire-Reload and/or Firereload.com including the Service we provide are and will remain the exclusive property of Firereload.com . "FR” logos, icons and other marks identifying FR services or products are trademarks of FR and may not be used without prior written permission. Except as otherwise expressly set forth in these Terms, you may not copy,reproduce, distribute, or create derivative works of the Service or the Site without FR's express written authorization (excluding sharing on social media for marketing purposes). All rights not expressly granted in this agreement (but applicable in law) are reserved to FR.
Disclaimer of Warranties
The service and content available to you at FR is at your sole risk and you will be solely responsible for any damage to your computer system or loss of data that results from downloading files, software, or any services/ content thereof. (As stated above, software uploading/ use on FR is prohibited.)
General Information
The following section will bind you to arbitration should any issues arise involving FR. Read this carefully and completely:
This agreement shall be governed by, construed and enforced in accordance with the laws of the State of Washington. You and FR collectively herein waive trial by jury and agree to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Kitsap County, State of Washington. In the event that litigation results from or arises out of this Agreement or the performance thereof, the parties agree (to):
(i) Notify FR in writing of any arbitral claim within thirty (30) days of the date the claim arises, so that FR and you can attempt in good faith to resolve the issue (claim) informally. After the 30 days, the issue will be considered null and void of any liability on the part of FR.
(ii) Reimburse the prevailing party's reasonable attorney's fees, court costs, and all other expenses, whether or not taxable by the court as costs, in addition to any other relief to which the prevailing party may be entitled.
(iii) In any event, finding, or final resolution resulting from arbitration, FR liability will not exceed $50 US dollars.
(iv) Arbitration will be conducted confidentially by a single arbitrator.
(v) The courts of the State of Washington and the United States, respectively, sitting in Kitsap County, Washington has exclusive jurisdiction over any appeals and the enforcement of an arbitration award.
(vi) Any claim or dispute that is deemed not subject to arbitration or cannot be settled by arbitration shall be resolved in the state or federal courts of the State of Washington in The United States, residing in King County, Washington.
(vii) Any claim related to or from these Terms will be resolved solely through individual arbitration and will not be presented as class arbitration, class action or any other type of legal proceeding against or involving FR.
(viii) No individual will attempt to resolve a claim as a representative of another individual or group of individuals in class arbitration against or involving FR.
If any part of this Agreement is deemed to be unenforceable, the balance of the Agreement shall remain in full force and effect. This document contains the entire agreement between the parties with respect to the subject matter hereof, and may not be amended, nor any obligation waived, except by a writing signed by both parties hereto. Any failure to enforce any provision of this Agreement shall not constitute a waiver thereof or of any other provision. You may not assign or transfer these Terms or any rights hereunder, and any attempt to the contrary is void. These Terms shall inure to the benefit of and be binding upon each party's successors and assigns. FR shall not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond FR's reasonable control. These Terms constitute the complete and exclusive understanding and agreement of the parties relating to the subject matter hereof and supersedes all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral.
Some parts of the United States do not allow the exclusion, limitation or minimization of liability for incidental or consequential damages. That being said, some of the content in this section may or may not apply in your area.
